A. Overview

  • For a first-time user, the tutorials in this product provide approximately two (2) cumulative hours of foundational learning on the "big-ticket" topics that you must know about Evidence: Hearsay. The duration and direction of your follow-up use will vary according to your needs and preferences.

    • Absence of entry in regularly conducted activity;
    • Public records and reports; and
    • Additional exceptions.
  4. Exceptions: Declarant's Unavailability Required
    • Former testimony;
    • Dying declarations;
    • Statements against interest;
    • Forfeiture by wrongdoing;
    • Residual exception; and
    • Hearsay within hearsay.
  5. Hearsay and the Confrontation Clause
    • The confrontation clause and Crawford.
